Prices are stated in euros (€).

As a micro-enterprise benefiting from the VAT exemption scheme, VAT is not applicable pursuant to Article 293 B of the French General Tax Code.

5. Orders

An order is considered final once payment has been confirmed.

BALQIS Modest Essentials reserves the right to cancel an order in the event of fraud, incomplete information or force majeure.

6. Payment

Payment is due immediately when the order is placed.

The available payment methods are those offered during the checkout process.

Payments are processed by the payment service providers available at checkout, in accordance with their own security measures.

7. Delivery

Orders are prepared within 1 to 3 business days, unless otherwise stated.

Delivery times depend on the delivery method selected and are communicated to the customer before the order is confirmed.

BALQIS Modest Essentials remains responsible for the proper performance of the delivery in accordance with applicable law.

In the event of delayed or failed delivery, the customer benefits from the remedies provided under the French Consumer Code.

8. Right of Withdrawal

In accordance with applicable law, the customer has 14 days from receipt of the order to exercise their right of withdrawal without having to provide a reason.

After informing BALQIS Modest Essentials of their decision to withdraw, the customer has 14 days to return the products. Return shipping costs remain the responsibility of the customer unless otherwise stated.

Refunds are made in accordance with applicable legal provisions and the terms set out in our Refund Policy.

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to products made to the customer’s specifications or clearly personalised, including Gift Boxes that have been personalised specifically at the customer’s request.

A standard withdrawal form is provided to the customer.

9. Legal Guarantees

Products sold by BALQIS Modest Essentials benefit from the legal guarantee of conformity provided for by the French Consumer Code and the legal guarantee against hidden defects provided for by the French Civil Code.

Legal Guarantee of Conformity

The consumer has a period of two years from delivery of the product to request the application of the legal guarantee of conformity when a lack of conformity appears.

Under this guarantee, the consumer may request the repair or replacement of the product, free of charge, under the conditions provided by law. The product must be brought into conformity within a maximum period of 30 days following the request and without significant inconvenience to the consumer.

Where repair or replacement is impossible, is not carried out under the conditions required by law, or where the lack of conformity justifies it, the consumer may, subject to the applicable legal conditions, request a price reduction or the termination of the contract and a refund for the product.

Where a product is repaired under the legal guarantee of conformity, the guarantee period is extended by six months.

Where the seller requires replacement of the product even though the consumer requested repair, the replacement product benefits from a new two-year legal guarantee of conformity from the date of replacement.

Rights relating to the legal guarantee of conformity arise from Articles L.217-1 to L.217-32 of the French Consumer Code.

Legal Guarantee Against Hidden Defects

The consumer also benefits from the guarantee against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code.

The consumer has two years from the discovery of the defect to take action.

Subject to the conditions provided by law, this guarantee may allow the consumer either to keep the product and obtain a reduction in price or to return the product and obtain a refund.

10. Liability

BALQIS Modest Essentials is responsible for the performance of its obligations in accordance with applicable law.

BALQIS Modest Essentials shall not, however, be held liable for damage resulting from improper use of the products, fault on the part of the customer or an event constituting force majeure under French law.

These provisions do not limit or exclude any mandatory rights granted to consumers under applicable law.

Personal data collected in connection with the use of the website and orders is processed in accordance with our Privacy Policy.

This policy explains, in particular, the data collected, the purposes for which it is processed, its recipients, retention periods and the rights available to customers.

12. Intellectual Property

The elements appearing on the BALQIS Modest Essentials website, including texts, photographs, images, graphics, logos, visual elements, videos and layouts created for the store, are protected by applicable intellectual property rights, subject to rights belonging to third parties.

Any reproduction, representation, modification or use, in whole or in part, of these elements without the prior authorisation of BALQIS Modest Essentials or the relevant rights holder is prohibited, except where permitted by law.

13. Applicable Law and Dispute Resolution

These Terms and Conditions of Sale are governed by French law.

Where the customer is a consumer residing in another Member State of the European Union, the choice of French law shall not deprive them of any mandatory protections granted by the applicable law of their country of residence.

In the event of a dispute, the customer is invited to contact BALQIS Modest Essentials first in order to seek an amicable solution.

If no amicable solution can be reached, the dispute may be brought before the competent court in accordance with the applicable legal rules.
